（Sample ICs）

NOVOSENSE provides the Sample ICs under the following terms and conditions：

NOVOSENSE hereby provides you the Sample ICs (the “Goods”) , which are intended for use for engineering development, demonstration, or evaluation purposes only. You shall not use the Goods for other purposes. The Goods are not deemed to be used in finished end-products applicable to general consumer use. In view of this, the Goods provided may not be complete in terms of required design-, marketing-, and manufacturing-related protective considerations, including product specification, product reliability, product safety and environmental measures typically found in end products that incorporate such semiconductor components or circuit boards.

If you are a higher education institution in mainland China and you apply for the Goods through the university sample application channel, such Goods shall be used solely for teaching and scientific research purposes, and shall not be used for any commercial purposes, nor resold, transferred, or provided to any third party in any manner.

It should be noted that the university sample application channel is only open to higher education institutions legally established in mainland China and their affiliated departments, laboratories, and research groups. NOVOSENSE does not accept sample applications from universities, research institutions, or other organizations outside mainland China.

NOVOSENSE has the right to decide, at its sole discretion, the actual sample models and quantities to be distributed based on inventory availability, intended use, and evaluation results. The sample models and quantities filled in by you at the time of application shall serve only as a reference for evaluation and shall not constitute a distribution commitment by NOVOSENSE; the actual distribution shall be subject to the samples finally confirmed and delivered by NOVOSENSE.

NOVOSENSE reserves the right to make corrections, modifications, enhancements, improvements, and other changes to the Goods and services at any time. You should obtain the latest relevant information before placing orders.

Please read the Datasheet carefully before handling the Goods. Persons who handle the Goods must be trained in electronics and shall observe good engineering practice standards. The user assumes all responsibility and liability for proper and safe handling of the Goods. Further, the user shall indemnify NOVOSENSE against all claims arising from the handling or use of the Goods. Due to the open construction of the Goods, it is the user’s responsibility to take all appropriate precautions with regard to electrostatic discharge. Please store the Goods according to the storage conditions in the JEDEC standard.

The Goods are neither designed nor intended for use in military/aerospace applications or environments. You shall be responsible for compliance with all applicable legal and regulatory requirements.

You shall inspect the Goods within 7 days after receipt of the Goods. If the Goods fail to meet the specifications indicated in the latest Datasheet, after confirmed by NOVOSENSE, the Goods could be returned or replaced. The foregoing warranty is the exclusive warranty made by NOVOSENSE to you and is in lieu of all other warranties, expressed, implied, or statutory, including any warranty of merchantability or fitness for any particular purpose.

Except to the extent of the liability set forth above, NOVOSENSE shall not be liable to you or any user for any special, indirect, incidental, or consequential damages. NOVOSENSE assumes no liability for applications assistance, customer product design, software performance, or infringement of patents or services described herein.

The trading arrangement between NOVOSENSE and you is not exclusive. The supply of Goods by NOVOSENSE to you does not imply the granting of any license under any patents or other intellectual property rights of NOVOSENSE to you. You shall protect the intellectual property rights and trade secrets of NOVOSENSE.
